Terms & Conditions

These terms apply to all courier, messenger, and freight services provided by Top Gun Courrier ("Top Gun"). By placing an order, you accept these terms.

1. Service levels

Top Gun offers six levels: DIRECT (MACH II), URGENT (Super) — 90 min Montréal region, REGULAR (Basic) — 180 min, AM/PM, SPECIAL (evenings + weekends), and PALLETS. Delivery windows begin at pickup and are subject to traffic, weather, customs, and partner air/ocean carrier capacity.

2. Pricing

Rates vary by service level, distance, weight, volume, and mode (bike, road, air, ocean). Quotes provided on request; commercial accounts use the agreed rate schedule. Cross-border (US) and international pricing is quoted case-by-case, with customs duties either included or billed separately per agreement.

3. Fuel surcharge

A fuel surcharge applies to road and air shipments. It is reviewed on the first Monday of each month based on data from the Régie de l'énergie du Québec. The current rate is published and billed transparently. Bike deliveries are exempt.

4. Payment methods

Accepted: Visa · MasterCard · American Express. Commercial accounts: weekly or monthly billing, online, by fax, or by mail. Payment due within 30 days of billing unless otherwise agreed.

5. Liability

Top Gun exercises reasonable care in handling shipments. Our maximum liability for loss or damage is limited to the declared value of the contents, up to CAD $100 per shipment on intercity modes, and per the partner carrier's coverage for cross-border and international shipments, unless additional insurance has been expressly purchased and billed.

We are not liable for delays caused by: exceptional weather, force majeure, customs inspections, refusal by partner carriers, incomplete or incorrect addresses, or recipient unavailability.

6. Excluded items

Excluded from transport: undeclared hazardous materials, illegal goods, negotiable securities, cash, uninsured jewelry, perishables without prior arrangement, fragile items not packed to specification, embargoed or sanctioned goods. Full list available on request.

7. Cross-border and international

For US and international shipments, the shipper provides an accurate description of contents, declared value, and all required customs documents (commercial invoice, certificate of origin, licenses). The shipper remains responsible for duties, taxes, and brokerage fees unless agreed otherwise (Incoterms to be confirmed in writing).

8. Proof of delivery

Every shipment is confirmed via your customer account. A signature may be required at destination depending on the package's nature.

9. Cancellation

An order may be cancelled free of charge before pickup. After pickup, cancellation will be billed at the rate of the service rendered.

10. Claims

Any claim for loss or damage must be submitted in writing within 5 business days following delivery, to info@topguncourrier.ca.

11. Governing law

These terms are governed by the laws of Québec and Canada. Any dispute will be brought before the courts of the judicial district of Longueuil.

12. Changes

Top Gun reserves the right to amend these terms at any time. Changes take effect upon publication on the site.
